By making the purchase online through the website www.dulicy.com, the user declares that he accepts and knows these terms and conditions of sale.

These Terms and Conditions are understood to be agreed between the company Naturius,Lda (www.dulicy.com) and individuals – individual or collective – who browse or make purchases through the website in question, hereinafter referred to as “Customer”.

Both parties agree that their relationship will be governed exclusively by these terms of use and the additional information available on this site.

SECURITY AND CONFIDENTIALITY

Dulicy guarantees the security and confidentiality of all data provided by Customer during and after the process of purchase of our parts. The information and data provided by users will only be used for the management of customer accounts, billing effects and deliveries.

PRICES

Prices presented at the Dulicy online store may undergo any adjustments due to unpredictable and uncontrollable changes by the brand. This includes, for example, the change in the price of origin.

All prices include VAT applicable at the legal rate in force.

Dulicy’s prices can be changed with a simple notice to the customer. The new prices are applicable to all orders with delivery pending at the date of change.

PAYMENTS

Payment must be made immediately after ordering. If Customer fails to comply with its payment obligation, Dulicy will suspend the order.

The parts orders must be paid through available electronic means of payment, whose costs are fully borne by the Customer.

GENERAL CONDITIONS OF PURCHASE

All purchases made at the Dulicy online store are subject to the current purchase conditions. When you formalize the request, the Customer is accepting the same.

DELIVERY AND TRANSPORTATION

Dulicy delivery times may depend on force majeure. These include manufacturing accidents, supplier delays, strikes and government constraints. In the event of such circumstances, Dulicy shall not be liable for delays or impossibility of delivery. In these cases, the Customer does not have the right to cancel the order or demand compensation from the company.

Dulicy no longer has any responsibility for the parts from the moment they leave our premises and are made available to the carrier. Regardless of the transport used, the possible risks of poor transportation are the sole responsibility of the Customer.

Except as previously agreed or indicated in the special conditions of each part, Dulicy assumes no risk of transportation, which includes damages and deteriorations due to unforeseeable circumstances or force majeure.

ORDER PROCESS

To start the purchasing process, the Customer must access the website www.dulicy.com and view the different products available in the online store. On the individual page of each product a detailed description and images of the part are presented.

Products can then be added to a shopping list. To do this, the Customer must use the order / purchase option online: add to cart. Several products can be added to the shopping list before the order is placed.

At the end, the Customer must access your shopping list and complete the ordering process. This will occur with the completion of a form where the information and data of the Client are requested. Here, the Client must indicate the means of payment intended.

The data collected in the Customer’s registry are considered confidential and will be treated by Dulicy in accordance with the legislation in force. At any time, you may request corrections or deletion of the data from the database.

RESPONSIBILITIES

All parts sold in Dulicy online store comply with Portuguese legislation.

Dulicy assumes no liability for damage resulting from interference, computer viruses, interruptions, malfunctions or disconnections of the system that may prevent access to, navigation or provision of services to Users of the www.dulicy.com website.

CUSTOMER AND USER OBLIGATIONS

It is forbidden to sell to minors under 18 years of age. The Customers and Users must comply with these conditions and respect them, committing themselves to fulfill the following obligations:

It is prohibited to introduce, disseminate or store through the website defamatory, obscene, insulting, xenophobic and / or any content that violates the general principles of law and public order;

Do not use false identities;

Provide the personal data and correct addresses so that Dulicy can process the order properly;

Fill out the order form correctly, providing true information.

The Customer is also responsible for the veracity of the data provided to Dulicy and undertakes to advise immediately if any changes occur. Dulicy shall not be liable for any delays or delays in the processing of orders, particularly on delivery, resulting from errors or insufficiency of data communicated by the Customer.

AVAILABILITY OF PARTS

The products in our online store can be viewed physically and inspected by the competent authorities in our headquarters.

Dulicy only processes the order after confirmation of payment by the Customer. For this reason, Dulicy can not guarantee the availability of the products until the beginning of the respective payment. The shipping time depends on the carrier and the destination of the order.

Dulicy only submits on weekdays. For this reason, weekends or holidays are not counted in the estimated delivery of parcels.

The average delivery times for Dulicy parts are 48 hours useful for parts in stock and for deliveries in Portugal. For the European Union, the deadline increases to six working days.

The above delivery times are indicative and therefore considered valid when there are no physical or structural impediments.

Any delay in the shipment of parts, given the estimates presented, does not give the Client the right to compensation.

The shipment of orders is accompanied by the invoice.

The Customer is entitled, upon receipt of the order, to open the packaging to verify that the product is in accordance with what was ordered and does not present external defects.

Dulicy will be required to refuse reimbursement or replacement requests for products that are external defective and that have been accepted by Customer at the time of delivery. The right of withdrawal remains valid in cases of technical problems detected by the Customer after delivery and in accordance with the terms provided by law. When you receive the order, you must:

1.Check that the packaging is in perfect condition;

2.Open the packaging, asking the courier to wait for the verification of the order status;

3.Check that the part is in accordance with the order made and that it has no visible defects. You should only accept the order if everything is in order.

4.In the event of any visible problem or defect, Customer shall refuse delivery and complete the form for such cases.

5.Return the packaging and its contents to the carrier’s office.

6.Send an email within 24 hours to report the problem to Customer Service or email comercial@dulicy.com.

CANCELLATIONS, EXCHANGES AND RETURNS

These terms and conditions of cancellation, exchanges and returns are applicable to purchases made at the Dulicy online store.

The Customer may cancel the order at any time until delivery. The cancellation entitles you to reimbursement of all amounts paid. Upon receipt of the order, Customer may exercise the right of free resolution under the terms legally provided and indicated below.

Failure to pay the order within ten days after being effected implies the automatic cancellation of the same.

Under the provisions of Law 7/2004 of 7 January on online commerce, Dulicy reserves the right to unilaterally cancel the order whenever there is a programming error, malfunction of the company’s electronic equipment or if the contractual offer arrives at its destination deformed and that it has an error in an essential element of the contract.

Within the scope of our Customer Satisfaction Policy and under applicable legal terms, Dulicy makes it possible to exchange or return articles. This must be done within 14 days from the date of receipt by the Customer. This request can be made without payment of compensation and without need to state the reason. In order to proceed with this request, the Customer must communicate the intention in writing, via email to comercial@dulicy.com. The articles must be returned within 14 days after receipt, accompanied by the original invoice and return note duly completed.

If you wish to exchange or return an item, you may contact Customer Support (+351 927 339 439 or comercial@dulicy.com). Here you will be provided with all the necessary information for the exchange or return process. If an item is sent without prior contact, it will not be ordered.

The exchange and return of Dulicy parts must comply with the following conditions:

Refund of the piece in good condition, with the original packaging complete and accompanied by the respective invoice;

Custom product exchanges are not accepted according to Customer’s specifications.

The address to which the Customer must send the piece for exchange or return will be indicated by the Customer Support.

The Customer is responsible for the correct packaging of the parts to be returned, as well as the shipping costs of the same.

All items for exchange or return will be checked upon arrival at Dulicy’s premises and will only be accepted if they comply with the conditions described above. Dulicy reserves the right not to accept parts that do not comply with such descriptions.

If the Customer chooses to refund the amount paid, the refund will be made by the same means of payment.

If you have received damaged parts or technical problems, Dulicy will arrange the collection of the parts at the place indicated by the Client, without any charge for the same.

Dulicy reserves the right to charge 10 euros of administrative expenses to the Customer who returns the articles for errors attributable to it.
